The Biden Administration has announced new actions to keep families together through a new executive action, “Parole in Place”, focusing on noncitizen spouses and children of U.S. citizens. These actions allow eligible individuals, who have resided in the U.S. for 10+ years, to apply for lawful permanent residency without leaving the country. Here’s what you need to know:
- Those legally married to US citizens- Must have been in the US for 10+ years (people who will benefit from this will have resided here on average for 23 years)- This benefits those who came into the US without inspection - with this they may apply for a green card in the US when otherwise they would not be able to do so within the US- Must also meet other legal requirements (screening w/ experienced immigration lawyer recommended)
- You can apply for "parole in place" which will give temporary protection from deportation and a work card and travel authorization- If approved after DHS-‘s case-by-case assessment, you will have 3 years to apply for a green cardThis action is anticipated to protect approximately 500,000 spouses of US citizens & approximately 50,000 non-citizen children under the age of 21 whose parent is married to a US citizen.
There is also some positive action in there for DACA recipients and other Dreamers (not sure who will qualify yet).
